We at Ray Cammack Shows, Inc., Inc. (“Ray Cammack Shows,” “we,” “us,” or “our”) have created this privacy policy (this “Privacy Policy”) because we know that you care about how the information you provide to us is used and shared. This Privacy Policy relates to Ray Cammack Shows, Inc.’s information collection and uses practices in connection with our Direct Ordering Platform.

By using our Services, you agree to the terms of this Privacy Policy and the accompanying Terms of Service.

Capitalized terms not defined in this Privacy Policy shall have the meaning outlined in our Terms of Service.

When you provide us with any Personal Information (as defined below), you consent to Ray Cammack Shows, Inc.’s collection, use, disclosure, and retention of your information per this Privacy Policy and as otherwise permitted by law.

 

 THE INFORMATION WE COLLECT

 

  1. PERSONAL INFORMATION

 

When you sign up to become a Registered User, we collect information that you provide to us, which includes personal information about yourself, such as your name, address, phone number, and e-mail address (collectively such provided information and any other information that can identify you as an individual directly or indirectly shall be herein referred to as “Personal Information”).



  1. PAYMENT INFORMATION

 

To submit orders through the Platform, you must provide certain information besides the Personal Information noted above. Such information may include a debit card number, credit card number, billing address, and similar information (collectively, the “Billing Information”).



  1. GEOLOCATIONAL INFORMATION

 

To provide access to the Services while using a mobile device, we automatically collect geolocational information from your mobile device, your wireless carrier, or certain third-party service providers (“Geolocational Information”). Such Geolocational Information is collected only when the Services are running on your mobile device. You may control the collection of Geolocational Information through the user settings on your device. You may decline to allow us to collect such Geolocational Information, in which case Ray Cammack Shows, Inc. cannot provide certain services to you because such Geolocation Information provides the functionality to the application. If you wish to change your geolocation preferences you may do so in the settings of your mobile device and it is your responsibility to keep these preferences up to date on your device over time.



  1. OTHER INFORMATION

 

In addition to the Personal Information, the Billing Information, and the Geolocational Information, we may collect additional information regarding you and your use of our Services, your interactions with us and our advertising, as well as information regarding your computer or other devices used to access our Services (collectively, the “Other Information”). Such Other Information may include:

 

From Your Activity. Information that we automatically collect when you use the Services, such as (i) information about the device from which you access the Services (i.e., the type of device, the advertising identifier (“IDFA” or “AdID”), the operating system and version (for example iOS, Android or Windows), your carrier and network type (WiFi, 3G, 4G, LTE); (ii) your IP addresses (which may consist of a static or dynamic IP address and will sometimes point to a specific identifiable computer or device); (iii) browser type and language; (iv) referring and exit pages and URLs; (v) date and time; (vi) amount of time spent on particular pages; (vii) what features of the Services you use or visit, including your use of either Direct or Discover (or both); (viii) what you order and from which restaurants; and (ix) similar information concerning your use of the Services.

 

From Cookies. Information that we collect using “cookie” technology. Cookies are small packets of data that a website stores on your computer’s hard drive so that your computer will “remember” information about your visit. We use cookies to help us collect Other Information and to enhance your experience using the Services. Specifically, we use cookies to authenticate users, personalize your experience when using the Services, analyze which features of the Services you use most frequently, and measure and optimize advertising and promotional effectiveness. To do this, we may use both session cookies, which expire once you close your web browser, and persistent cookies, which stay on your computer until you delete them. If you do not want the Services to place a cookie on your hard drive, you can turn that feature off on your computer or mobile device. Please consult your Internet browser’s documentation for information on how to do this. However, if you decide not to accept cookies from us, the Services may not function properly. When the Services are made available to you through Facebook (via our Plugin) and other third-party sites, please be aware that these other sites maintain their policies regarding cookies and the collection and use of information. You are responsible for reviewing those policies.

 

Third-Party Analytics. We use third-party analytics services (such as Google Analytics) to evaluate your use of the Services, compile reports on activity, collect demographic data, analyze performance metrics, and collect and evaluate other information relating to the Services and mobile and Internet usage. These third parties use cookies and other technologies to help analyze and provide us with the data. By accessing and using the Services, you consent to process data about you by these analytics providers in the manner and for the purposes set out in this Privacy Policy. The information used by such analytics services is generally at the aggregate level. We collect data through Google Analytics, which uses cookies and technologies to collect and analyze data about use of the Online Services. These services also collect data regarding the use of other websites, apps, and online resources. THE INFORMATION COLLECTED THROUGH THIRD-PARTY ADVERTISING COMPANIES

 

We share Other Information about your activity in connection with your use of the Services with third parties to tailor, analyze, manage, report, and optimizing advertising you see on the Platform, the Website, the Apps, the Plugin, and elsewhere. These third parties may use cookies, pixel tags (web beacons or clear gifs), and other technologies to collect Other Information. Pixel tags enable us, and these third-party advertisers, to recognize a browser’s cookie when a browser visits the site on which the pixel tag is located to learn which advertisement brings a user to a given website. By using the Services, you consent to this collection.




ACCESSING AND MODIFYING PERSONAL INFORMATION AND COMMUNICATION PREFERENCES

 

If you have registered for the Services, you may access, review, and delete your Personal Information, Billing Information, and other Information by following the RCS FunPass APP Menu instructions. Registered Users may opt out of receiving emails from us, provided, however, we reserve the right to send you transactional emails as required to fulfill any transaction requested or placed by you relating to your account or as otherwise required by any laws, regulations, orders, or contractual obligations.. 



HOW WE USE AND SHARE INFORMATION

 

We use the Billing Information to process your orders and the Geolocational Information to recommend nearby Fair locations.

 

To better understand our users and Services, we might analyze the Other Information and the Geolocational Information in aggregate form to operate, maintain, manage, and improve the Services. This aggregate information does not identify you personally. We may share this data with our affiliates, agents, and business partners. We may also disclose aggregated user statistics to describe our products and services.

 

We may employ other companies and individuals to perform functions on our behalf. Examples include providing marketing assistance, order fulfillment, billing, and customer service. These other companies will have access to the Personal Information, the Billing Information, the Geolocational Information, and the Other Information only as necessary to perform their functions and to the extent permitted by law.

 

To the extent permitted by law, we may also disclose Personal Information, Billing Information, Geolocational Information, and Other Information when required by law, court order, or other government or law enforcement authority or regulatory agency or whenever we believe that disclosing such information is necessary or advisable, for example, to protect the rights, property, or safety of Ray Cammack Shows, Inc. or others.

 

We will take reasonable measures to require that the party receiving any of your Personal Information undertakes to (i) retain and use such information only for the purposes set out in this Privacy Policy; (ii) not disclose your Personal Information except with your consent, as permitted by law, or as permitted by this Privacy Policy; and (iii) generally protect the privacy of your Personal Information.



HOW WE PROTECT YOUR INFORMATION

 

We take reasonable steps to protect the Personal, Billing, Geolocational, and Other Information from loss, misuse, unauthorized access, disclosure, alteration, or destruction. Please understand, however, that security systems are not impenetrable. We cannot guarantee the security of our databases nor that the information you supply will not be intercepted while being transmitted to and from us over the Internet. In particular, e-mails sent to or from the Platform may not be secure, and you should take special care in deciding what information you send to us via e-mail.

 

 

IMPORTANT NOTICE TO NON–U.S. RESIDENTS

 

The Services are operated in the United States. If you are located outside of the United States, please be aware that any information you provide to us will be transferred to the United States. We will take reasonable measures to require that the party receiving any of your Personal Information undertakes to (i) retain and use such information only for the purposes set out in this Privacy Policy; (ii) not disclose your Personal Information except with your consent, as permitted by law, or as permitted by this Privacy Policy; and (iii) generally protect the privacy of your Personal Information. By using the Services and providing us with any information, you consent to this transfer.

 

CHILDREN

 

We do not knowingly collect Personal Information from children under 13 through the Services. If you are under 13, please do not give us any Personal Information. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce our Privacy Policy by instructing their children never to provide us with Personal Information without their permission. If you have reason to believe that a child under 13 has provided Personal Information to us, please contact us, and we will endeavor to delete that information from our databases. 

 

EXTERNAL WEBSITES, GOOGLE WALLET, AND APPLE PAY

 

The Services may contain links to third-party websites. Ray Cammack Shows, Inc. has no control over the privacy practices or content of our business partners, advertisers, sponsors, and other websites to which we provide links. We are not responsible for those websites’ content or privacy policies. When visiting other websites, you should check the applicable third-party privacy policy and terms of use.

 

Please be advised that your use of Google Wallet or Apple Pay is subject to the terms and conditions, including the privacy policies, of Google and Apple, respectively.

CHANGES TO THIS PRIVACY POLICY

 

This Privacy Policy is effective as of the date stated at the top of this Privacy Policy. We may change this Privacy Policy occasionally and notify you of such changes (e.g., posting any changes on the Services, e-mailing you, or prompting you via a popup). By accessing the Services after we notify you of such changes to this Privacy Policy, you are deemed to have accepted such changes. Please refer back to this Privacy Policy regularly.

The privacy policy terms are only applicable to residents of California relating to the rights provided under the California Consumer Privacy Act of 2018 (“CCPA”), as amended by the California Privacy Rights Act of 2020 (“CPRA”). The CCPA provides personal information rights to California residents. The CCPA defines personal information as information that “identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular” California consumer or household. Personal information does not include publicly available information or consumer information that is deidentified or aggregate consumer information.

Categories of  Personal Information We Collect About You

We collect or generate personal information about you in a number of ways depending on the product or service and the relationship we have with you.  For example:

  •                     Your contact information, such as your name, email, and password. Such items are collected when you sign up for our Services.
  •                     Your public information, such as comments or reviews that you post in connection with our Services, such as, for example, on social media, application platforms, or otherwise.
  •                     Other information, such as your location, your IP address, the browser/device/hardware you are using, your GPS location and what pages you visit in connection with our Services.
  •                     When you communicate with us through or in connection with our Services, such as over the phone, via social media or other platforms, through email, or otherwise when provide information such as feedback, requests, or complaints, we collect the content of the communications and we may also collect personal information about you if provided throughout such communications;
  •                     When you interact with our Services we may collect digital information using cookies, web beacons, page tags, pixels or similar tools that we and our service providers and other third parties have set; and
  •                     When you interact with the sites via a social media platform, we may collect and use posts and other information, such as account ID or username.

We require this information to understand your needs and provide you with functionality and improved user experience relating to our Services, Content, and software.

  •                     Personal Identifiers: This includes first and last name, email address, and phone number;
  •                     Device and Online Identifiers and Related Information: This includes online identifiers, Internet Protocol (IP) address, email address, account information, phone number, social media profiles, unique device identifier and serial number, and other device information;
  •                     Internet, Application, and Network Activity: This includes communications you have sent to us via email, online form, through social media, and data related to user activity (e.g., browser visits and cookies or other similar technologies);
  •                     Location Data: We may receive information about your location and your mobile device, including a unique identifier for your device; in addition, in some instances, location information can be derived from your IP address or through your wi-fi connection.

Although you do not have to supply any of the personal information we request, we may not be able to provide products or services to you or you may not be able to interact with our sites if you do not.

The Purposes for Which Your Personal Information is Collected or Used

We use your personal information for the following business purposes:

  •                     To keep an internal record or our users and customers.
  •                     To provide you with relevant content, materials, offers, upcoming events, and relevant communications with our customers including responses to requests and questions whether via email, phone, or physical mail.

  •                     Performing analysis regarding customer’s use of our Services.

The Source of The Personal Information We Collect About You

  •                     When you directly provide information to us by, for example, registering with any of our Services or contacting us directly to provide feedback, recommendations, requests, or other communications.
  •                     Through tracking tools, such as cookies, tags and other technologies.
  •                     Our partners, affiliates, vendors, and contractors may provide us with information collected from you.
  •                     We may also use information from third parties whom we have a contractual relationship or from public sources such as social media, forums, app-stores, and other publicly available platforms.

Sharing of Your Personal Information

We may allow third parties to place and read their own cookies, web beacons, and other technologies to collect information through our Services. For example, our third-party service providers may use these technologies to collect information that may help us with traffic measurement, research, and analytics.

The information collected and stored by third parties remains subject to such third party vendor policies and practices. We do not have the ability to control such third party tracking technologies or how they may be used.

We collect data through Google Analytics, which uses cookies and technologies to collect and analyze data about use of the Online Services. These services also collect data regarding the use of other websites, apps, and online resources. Payment Processing

Selling of Your Personal Information

California law requires that we describe certain disclosures of personal information where we receive valuable consideration. California law treats such disclosures as “sales” even if no money is exchanged.

To the extent that Ray Cammack Shows’ use of Google Analytics as described above is considered to be a sale of your personal information (as the term “sell” is defined by the CCPA), you have the right to opt-out of that sale going forward.  As described above, you may opt out of the sharing of information by downloading Google Analytics opt out browser add-on at https://tools.google.com/dlpage/gaoptout.

Amount of Time Your Personal Information is Retained

We will retain your information only as long as we need it for legitimate business purposes and as permitted by applicable legal requirements. If you close your account, we will retain certain data for operational purposes and recordkeeping, as well as to prevent fraud, enforce our terms and conditions, take actions we deem necessary to protect the integrity of our Services or our users, or take other actions otherwise permitted by law. In addition, if certain information has already been provided to third parties as described herein, retention of that information will be subject to those third-party policies.

Rights to Your Personal Information

You have certain legal rights when it comes to your personal information under the California Consumer Privacy Act (CCPA). Without being discriminated against for exercising these rights, you have the right to request that we disclose what personal information we collect from you, the purposes for which we disclose your personal information, the right to request that we delete that information, the right to correct inaccurate personal information and to opt-out of the sale or sharing of your personal information, subject to certain restrictions.

Right to Know

You have the right to request that we disclose what categories of your personal information we collect, use, or sell the purposes for which the personal information is disclosed.  You may request access to the specific pieces of personal information that we have collected from you. (“Right to Know”)

Right to Delete

You have the right to request that we delete your personal information, subject to certain limited exceptions. For example, we may retain an archived copy of your records consistent with applicable law. (“Right to Delete”)

Right to Correct

You have the right to request that we correct inaccurate personal information that we collect about you, taking into account the nature of the personal information and the purposes of the processing of the personal information. (“Right to Correct”)

When submitting any requests relating to your rights under CCPA please provide your Name, Date of Birth, Email, and Telephone Number.  We will use this information to verify your identity using reasonable methods in order to process your rights request. These methods may include matching information you provided to us with information already maintained by us or through the use of a third party identify verification service.

Please note that we cannot respond to your request or provide you with personal information if we are not able to verify your identity or authority to make the request or confirm the personal information relates to you.
